The Government bans the commercial use of moorings in regional ports in response to state regulations

PortsIB addresses the new state regulation and reminds that mooring points assigned to private vessels may not be used for economic purposes.

The Government of the Balearic Islands has issued a resolution to prevent moorings granted for private use in ports managed by the regional authority from being used for profit, such as the tourist rental of private boats. This measure is adopted in response to the entry into force of the state resolution that allows private recreational vessels to temporarily switch to commercial use, and in the exercise of the exclusive powers held by the Autonomous Community over the public port domain.

The resolution clearly states that any commercial use of these moorings constitutes a serious infringement, leading to the initiation of a sanctioning procedure and the immediate termination of the authorisation.

Base moorings in directly managed ports aim to maintain a balance between social moorings and profit-oriented moorings. Therefore, using social moorings for profit-making purposes undermines their intended purpose.

Ports de les Illes Balears (PortsIB), under the Ministry of the Sea and the Water Cycle, emphasises that the Balearic port management model clearly distinguishes between private and commercial uses, as they involve different and often incompatible impacts and needs. This distinction allows for maintaining the balance between nautical activity, the safety of facilities, and the protection of the coastal environment.

The Government stresses that the state resolution published in the BOE on July 22 does not alter the regional legal framework and cannot override the conditions of use established in the PortsIB occupancy titles. Therefore, controls and oversight of mooring use will continue to ensure that they are used exclusively for their granted purpose.

The resolution will be published in the BOIB and is already available for consultation on the Ports de les Illes Balears website.

At the same time, and to reinforce control over regional ports under indirect management, PortsIB has requested the concessionary entities to submit, within a maximum of ten days, a provisional proposal for the distribution of moorings according to their use. This proposal must clearly distinguish between those intended for private vessels and those reserved for professional activities, specifying whether the latter are for nautical charter or non-regular maritime transport.
