The General State Budget for 2022 came into force on 1 January.

The Ministry of Finance and Public Administration thus denies unverified reports that “a government error in the law delays the entry into force of the budget by 20 days”. This alleged delay is due to the fact that the articles of the 2022 Budget Law do not include a final provision establishing its entry into force.

However, the annual nature of the Budget is determined by the Spanish Constitution itself in Article 134.2. When the Budget is approved before 1 January, the final provision for entry into force is not necessary.

For example, the 2016, 2015, 2014, 2014, 2013, 2011, 2011, 2010, 2010, 2009, 2009, 2008, 2007, 2007, 2006, 2006, 2005, 2005, 2004, 2003, 2003, 2002, 2002, 2001, 2001, 2000, 1999, 1998, 1997, 1995, 1994, 1993, 1992 or 1991 budgets did not include an entry into force provision because they were approved in due time and form. It is therefore also untrue that the absence of such a provision in the 2022 SGPs is ‘an anomaly that has never occurred before, as the same information claims.

The Ministry of Finance and the Civil Service regrets that unidentified sources launch this type of hoax and that they are picked up and propagated without being verified.

It also regrets that the PP contributes to generating confusion when it is enough to read the Official State Gazette to see that all the PGE approved by Mariano Rajoy in due time and form lacked a provision for entry into force.
