Following the announcement that the company that manages the Hotelbreak platform is in the process of ceasing activity, due to its financial situation, the Directorate General for Benefits, Pharmacy and Consumer Affairs recommends that people keep all documentation, such as invoices, orders, proof of payment or e-mails. It is also advisable to file a complaint with the responsible company.

Hotelbreak had charged users for the service but had not paid the establishment. Others affected, on the other hand, claim that they cannot make use of the wallet money they had available with the company. In all cases, those affected have tried to contact the company without success.

If the purchase was paid for by credit card, it is recommended to contact the financial institution to find out about the possibility of cancelling the charge.

For more information, you can contact the Directorate-General for Benefits, Pharmacy and Consumer Affairs to find out about your rights as a consumer or how to file a complaint. To do so, you can consult the Consumer Portal for updated information on the closure of Hotelbreak:

If Hotelbreak finally applies for insolvency proceedings and is accepted, a notice declaring the company to be in insolvency proceedings will be published in the Official State Gazette (BOE). At the same time, an insolvency administrator will be appointed, who will be in charge of the management of the company for the duration of the insolvency proceedings.

All affected persons may, within one month of the publication of the above announcement, submit all claims (amounts claimed) they have against the company to the appointed insolvency administrator.

Those affected can go to court, although it is advisable to first claim the company. To do so, it is necessary to have the assistance of a lawyer and solicitor, who will be in charge of directing the proceedings.

However, when the amount of the claim does not exceed 2,000 euros, and in the cases provided for in the applicable regulations in force, the citizen may file a legal claim without the need to be assisted by a lawyer and solicitor.

To this end, it is recommended that the person contact the Administration of Justice to obtain the necessary information and advice to initiate the corresponding legal proceedings.
