Political Agreement on Gibraltar between the EU and the UK

The Spanish Foreign Minister José Manuel Albares, UK Foreign Secretary David Lammy, European Commissioner Maroš Šefčovič, and Gibraltar Chief Minister Fabian Picardo met in Brussels and reached a final political agreement on the key elements of a future EU–UK agreement regarding Gibraltar.

Political Agreement on Gibraltar between the EU and the UK

Key points of the agreement:

  • Free movement: All physical barriers and border checks between Spain and Gibraltar will be removed, while maintaining the integrity of the Schengen Area and the EU Single Market.
  • Dual border controls in Gibraltar: At Gibraltar’s port and airport, joint border checks will be established. Spain will conduct full Schengen checks, while Gibraltar will maintain its internal checks.
  • Customs union: The agreement sets the foundations for a customs union between the EU and Gibraltar, eliminating goods checks and establishing indirect taxation principles (including on tobacco) to avoid distortions and support regional prosperity.
  • Other commitments: Level playing field provisions on state aid, taxation, labour rights, environment, trade, sustainable development, anti-money laundering, and transport (including the airport).
  • Social protection: Guarantees rights for cross-border workers and ensures social security coordination.
  • Financial mechanism: A special fund will be created to promote employment, training, and social cohesion in the region.

This agreement does not affect the respective legal positions of Spain and the UK on sovereignty and aims to promote shared prosperity, legal certainty, and regional cooperation.
