Parental Leave Extended to 19 Weeks in Spain

From 2 August 2024, each parent is entitled to 19 weeks of paid leave for the birth or care of a child (32 weeks for single-parent families). The first six weeks are mandatory immediately after birth, adoption, or fostering, while the remainder can be taken flexibly until the child turns one. An additional two weeks (four for single-parent families) may be used until the child turns eight.

Parental Leave Extended to 19 Weeks in Spain

The leave applies to employees, self-employed workers, and public servants who meet the minimum contribution period. The Social Security system covers 100% of the cost, and the benefit is exempt from income tax.

Applications can be submitted online with a digital certificate via the Tu Seguridad Social portal, without a certificate through the INSS platform, by post, or in person with an appointment. Required documentation includes proof of identity and, depending on the case, medical reports, employer certificates, and judicial or administrative resolutions.
