New legal framework updates regulations to ensure integration and visibility of Balearic entities outside the islands

The Balearic Government establishes a modern, functional legal framework adapted to current needs

The Consell de Govern has approved the Decree implementing Law 7/2023 of March 22 on Balearic or island communities residing outside the Balearic territory. This new regulation updates the previous framework — Law 3/1992 — which had become outdated and incomplete. The new Decree addresses aspects not covered by the 1992 law, structuring them according to current realities and aligning with principles of good regulation. It introduces specific measures in three main areas:

  1. The procedure for recognizing and revoking Balearic community status.
  2. The organisation and management of the official Register.
  3. The operation of the Council of the Balearic Islands Abroad.

Recognition of Balearic Community Status

Under the new Decree, applications for recognition must be submitted by the entity’s president or legal representative to the Directorate General for Institutional Relations and Relations with Parliament. This Directorate General is also responsible for officially registering the entity under the updated regulations.

Decree Approved to Implement Law 7/2023 on Balearic Communities Abroad

The Register will record the recognition of entities, as well as any related actions and documents. Required documentation includes the founding act, statutes, legal recognition in the host country, details of the governing body members, activity reports, and any significant amendments.

Registration will be managed electronically, while monitoring and certification activities will fall under the responsibility of the Directorate General for Institutional Relations and Relations with Parliament.


Council of the Balearic Islands Abroad

The Decree also establishes the creation and structure of the Council of the Balearic Islands Abroad, a collegiate advisory, consultative, participatory, and proposal-making body for matters concerning Balearic communities abroad.

The Council will advise the government on public policies targeting Balearic residents abroad, prepare reports, promote relations between institutions and communities abroad, and be mandatorily consulted during the drafting of legislation affecting these communities.

The Council will consist of a president, a vice president, a secretary, a plenary assembly, and standing committee, and may establish working groups. The plenary assembly will meet at least once every two years, and the standing committee at least once a year, with the possibility of holding extraordinary sessions in person, online, or in hybrid format.

Two additional participatory bodies are included: one connecting the Council with parliamentary groups of the Balearic Islands’ Parliament, and another with local entities. The first will meet at least one month before the plenary session to discuss legislative proposals affecting Balearic communities abroad.


A Modernised Legal Framework

With this decree, the Government of the Balearic Islands modernises and strengthens its institutional policy regarding Balearic communities abroad, providing a functional legal framework adapted to current needs for recognition, registration, and participation of these entities — with full legal and administrative guarantees.
