By means of a Mayor’s Decree, what Junts Avançam and GOB denounced was confirmed: that the demolition of the Hotel Formentor was carried out without the required municipal authorisation for the complete demolition of the hotel, and outside of the actions covered by the licence granted. An action that constitutes a serious infringement in accordance with the provisions of article 163.2.c). and the Urban Planning Law of the Balearic Islands (LUIB).

Thus, the commercial entity FORMENTOR BAY, S.L. is ordered to immediately suspend the works in progress within 24 hours, without prejudice to the sanctioning measures of the works in progress; a procedure for the restoration of urban legality is initiated against this entity and a period of 2 months is given to apply for the appropriate license.
The GOB has requested and has been granted in this decree, access to the entire file, because from the GOB, although we welcome the suspension of the works for the infringement arising from the integral demolition, we continue to warn that even and all reform and extension licenses do not conform to the General Planning of Pollença or the LUIB because, among other things, all of the plots of urban land in Formentor do not have the status of solar due to the lack of urban services provided by the PGOU and urban planning laws. For this reason, before new building licences can be granted, the parcelling and service provision projects for all the urban land must be approved and executed jointly, given that the current urban planning only provides for a single sector of action.
For this reason, the GOB continues to demand that the Town Hall review the legality of the licences granted so far for the Hotel Formentor.
