The Government of the Balearic Islands formally expressed its opposition in Madrid to the national decree establishing a single registry for tourist rentals, arguing that it encroaches upon regional powers and creates legal uncertainty affecting both the tourism sector and the islands’ economic fabric.

During the Tourism Sectoral Conference, the Regional Minister for Tourism, Culture and Sports, Jaume Bauzà, defended the Islands’ position against a regulatory framework promoted by the Ministry of Housing. According to the regional administration, tourism regulation falls exclusively within autonomous jurisdiction, and any state-level intervention in this area constitutes institutional overreach.

The Govern de les Illes Balears warns that the introduction of a national registry, in addition to the existing regional system, may result in a dual-registration structure that generates administrative confusion. Properties that are fully compliant and legally registered under Balearic regulations could face uncertainty if denied inscription in the property registry, potentially placing them in a regulatory limbo despite having met all regional requirements.

Furthermore, the administration highlights concerns that the new framework shifts operational responsibility to property registrars, which may create procedural bottlenecks and delays. This scenario could disproportionately affect small property owners and families who have operated lawfully for years, while insufficient enforcement mechanisms risk allowing illegal operators to continue their activity without effective oversight.

The Govern de les Illes Balears maintains that the appropriate path forward lies not in overlapping legislative mechanisms but in respecting the inspection and enforcement authority of autonomous communities, which in the Balearic Islands is exercised by the island councils.

During the same conference, the Ministry agreed to extend the deadline for submitting administrative justifications for grants related to the Tourism Sustainability Plans in Destinations (PSTD) until 31 March 2027. This extension will provide the Govern de les Illes Balears with additional time, following the completion of projects scheduled for June 2026, to review, amend and consolidate documentation from local entities before submission to the State Secretariat.

The regional administration considers this extension a necessary measure to ensure accurate administrative management and secure compliance in the allocation of public funds, while noting that the decision follows sustained requests from regional authorities seeking greater procedural flexibility.
